1. Who you are contracting with

NCIDE ("NCIDE", "we", "us") is operated by NCI Global ("the Seller"). By creating an account, generating a reading, or otherwise using NCIDE, you agree to these Terms. If you do not agree, do not use the service.

You confirm you are of legal age in your jurisdiction and that any information you provide is accurate.

2. What NCIDE is

NCIDE is an interpretive perception engine. It reconstructs an emotional reading from signals you submit (text, handles, optional images). It is not professional advice — not psychological, medical, legal, financial, or investment advice. A reading is a perspective, not a verdict, and outputs may be inaccurate. Decisions you make based on a reading are your own responsibility.

3. Acceptable use

You agree not to: (a) use NCIDE for anything unlawful, fraudulent, harassing, or abusive; (b) run readings on minors; (c) submit another person's private images or non-public data without consent; (d) infringe intellectual property or privacy rights; (e) attempt to interfere with the security of the service, including probing, scraping, scanning, uploading malware, or jailbreaking the model; (f) reverse engineer, resell, or redistribute the service or its outputs at scale.

You are responsible for the prompts and signals you submit, for verifying anything you act on, and for having the rights necessary to submit any content you provide. We may remove content, refuse outputs, or suspend accounts at our discretion. Rights-holders may contact hello@ncide.app to report infringing content; repeated infringers will be terminated.

4. Intellectual property

NCIDE, including its software, model prompts, interface, and branding, is owned by the Seller and protected by applicable IP laws. You receive a limited, non-exclusive, non-transferable right to use the service within your chosen plan. You retain ownership of the content you submit and grant us a limited license to process and host it solely to provide the service.

5. Service level

The service is provided "as is" and "as available". We do not guarantee uninterrupted, error-free, or perfectly accurate operation. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

6. Payments, billing, and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. See our Refund Policy for the refund window we honor.

7. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. On termination, your right to use the service ends; we may delete your data after a reasonable export window.

8. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the service is limited to the fees you paid in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law.

9. Changes

We may update these Terms from time to time. Material changes will be reflected by updating the date above. Continued use of the service constitutes acceptance of the updated Terms.
